Terms of Service

1. Who We Are

WigglyPaint (the "Service") is a website at wigglypaint.com operated by the WigglyPaint team ("WigglyPaint", "we", "us", "our"). The Service includes:

• WigglyPaint Drawing Tool — a free, in-browser drawing and animation application that runs entirely on your device.
• AI Paint — an optional paid feature that turns an uploaded photo into a stylized image using third-party AI image-generation services. AI Paint requires an account and prepaid credits.
• Community — a public gallery where signed-in users may share their artwork.

2. Acceptance of These Terms

By visiting, signing in to, or using the Service you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. We may update these Terms from time to time; we will update the "Last Updated" date at the top of this page, and material changes that affect paid features will be communicated by email and on this page before they take effect.

3. Eligibility & Accounts

• You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.
• You are responsible for keeping your sign-in credentials safe and for activity that occurs under your account. Tell us at support@wigglypaint.com if you suspect unauthorized access.
• You may delete your account from the Settings page at any time. Account deletion removes your profile, login, generated images, and uploaded photos from our active systems; it does not retroactively reverse completed payments.
• You can use the free Drawing Tool without an account. AI Paint, the Community upload feature, and Orders history require a signed-in account.

4. AI Paint Credits & Payments

AI Paint is sold as prepaid credit packs. 1 credit = 1 generated AI image.

• Pricing. Current credit packs and per-image pricing are displayed on the AI Paint pricing page. Prices are listed in US Dollars and shown before checkout.
• Payment processor. All payments are processed by Creem (creem.io). WigglyPaint does not collect, store, or have access to your full card number, CVC, or bank credentials.
• No subscription. Credit purchases are one-time purchases. Nothing renews automatically.
• Credits do not expire while your account remains active. They are non-transferable, have no cash value outside the Service, and are not redeemable for cash.
• Spending a credit. A credit is consumed when a generation request is successfully accepted and processed by the AI provider. If a generation fails due to a fault on our side (for example, an internal error), we refund the credit automatically. Generations rejected by content moderation are documented in section 6.
• Refunds on unused credits. You may request a refund of unused, unspent credits within 14 days of purchase by emailing support@wigglypaint.com from the email address on file. Refunds will be issued via the original payment method through Creem. Credits already spent on generated images are non-refundable.
• Chargebacks. If you believe a charge is wrong, please contact us first; we usually resolve issues quickly. Filing a chargeback for a legitimate purchase may result in account suspension and forfeiture of remaining credits.
• Taxes. You are responsible for any taxes applicable to your purchase that are not included in the listed price.

5. User Content

Drawings (Drawing Tool). Drawings you create in the free Drawing Tool are processed locally on your device and never leave it unless you choose to download, share, or upload them.

Photos you upload to AI Paint. When you use AI Paint, you upload a source photo. You confirm that:

• You own the photo, or have permission from everyone identifiable in it to upload and transform it.
• You grant WigglyPaint a limited, worldwide, non-exclusive license to store the photo on our infrastructure, send it to our AI service provider for processing, and produce the requested stylized output. This license is solely for the purpose of operating AI Paint for you, and ends when you delete the photo or your account.
• You retain all ownership and intellectual-property rights in the photo and in the resulting generated image, subject to the rights of any AI provider as required by applicable law. WigglyPaint does not claim ownership of your art.

Public Community uploads. If you choose to publish an artwork to the public Community gallery, you grant WigglyPaint a non-exclusive, royalty-free license to display, distribute, and promote that artwork on the Service. You can remove your post from your profile at any time, which revokes the public display license going forward.

6. Acceptable Use & Content Moderation

You agree not to use the Service to upload, generate, transmit, or share content that:

• Depicts minors in a sexual, suggestive, or otherwise exploitative manner. This is strictly prohibited and may be reported to the appropriate authorities.
• Is sexually explicit (including non-consensual nudity, deepfakes, or sexual content involving real persons without their explicit consent).
• Promotes terrorism, violent extremism, or self-harm.
• Harasses, threatens, defames, or doxes any person.
• Depicts identifiable real people without their consent in ways that could harm their reputation or deceive others.
• Promotes illegal activity, hate speech, or discrimination based on protected characteristics.
• Infringes intellectual-property rights you do not hold, including copyrighted characters, trademarks, or celebrity likeness used commercially without permission.
• Contains malware, attempts to attack or probe our infrastructure, or abuses rate limits or credit accounting.

Moderation. AI Paint requests are screened by an automated content-moderation service (operated by Creem) before they are sent to the image-generation provider. Requests that the moderator flags or denies are rejected without consuming a credit. We may additionally review or remove generated content that violates these Terms and may suspend or terminate accounts that repeatedly violate this section.

Reporting abuse. If you see content on the public Community gallery that violates these Terms, please email support@wigglypaint.com.

7. Intellectual Property

The WigglyPaint name, logo, website design, source code, and the underlying Drawing Tool engine (Decker) are owned by WigglyPaint or its licensors and are protected by applicable intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

8. Third-Party Services

AI Paint relies on third-party providers, including but not limited to:

• Creem — payment processing and prompt moderation API.
• An AI image-generation provider — image-to-image generation requests.
• Cloudflare — hosting, R2 object storage for uploaded and generated images, and edge networking.
• Google Analytics & Google AdSense — site analytics and ads on free, public pages.

These providers operate under their own terms and privacy policies. The Privacy Policy describes what we share with them and why.

9. Service Availability & Changes

We work hard to keep WigglyPaint available, but the Service is provided on an "as is" and "as available" basis. We may add, change, or discontinue features (including AI Paint templates) at any time. If we discontinue AI Paint entirely, we will refund the cash value of unspent credits to the original payment method.

10. Disclaimers

To the maximum extent permitted by law, the Service and any generated images are provided "as is", without warranty of any kind, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that AI Paint outputs will meet your expectations or be suitable for any particular use, and we are not responsible for decisions you make based on a generated image.

11. Limitation of Liability

To the maximum extent permitted by applicable law, WigglyPaint and its operators, contributors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the total amount you paid to us for credits in the twelve months before the event giving rise to the claim, or (b) USD $50. Some jurisdictions do not allow these limitations, in which case they apply only to the maximum extent permitted by law.

12. Indemnity

You agree to defend, indemnify, and hold harmless WigglyPaint from claims, damages, and expenses (including reasonable legal fees) arising from content you upload, generate, or post, or from your breach of these Terms.

13. Termination

You can stop using the Service at any time. You can delete your account, generated images, and uploaded photos from the Settings page. We may suspend or terminate access to the Service if you breach these Terms, in particular section 6 (Acceptable Use). On termination, your right to use the Service ends; sections that by their nature should survive (including payments, intellectual property, disclaimers, limitation of liability, and indemnity) will survive.

14. Governing Law & Disputes

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws principles. Mandatory consumer-protection laws of your country of residence still apply to you. Disputes will first be addressed in good faith by contacting support@wigglypaint.com; if they cannot be resolved informally, they will be submitted to the exclusive jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights you have in your country.
